Most
people know little about bankruptcy, and a common question is "How do I
find out my options?" The answer is that a person with financial difficulty
should take the time to review all aspects of their financial situation,
and speak with a knowledgeable counselor.
Two
common types of Consumer Bankruptcy are Chapter 7 and Chapter 13. Chapter
13 Bankruptcy (Reorganization) is a partial repayment of debt, which is
employed where there is some, but perhaps not enough money left over at
the end of the month to pay debts. This type of bankruptcy aids in restructure
of some contracts; partially discharging unsecured debt; and aiding in
the cure (catching up) of defaults on secured debts such as motor vehicles
and home mortgages. Chapter 13 can also temporarily restructure student
loans and child support arrears repayments; and is often employed to resolve
tax matters. Chapter 13 payment plans typically extend from 3 to 5 years,
and payments are made to the United States Chapter 13 Trustee.
Budgets
that have little money left over for creditors, or are "in the red", might
require the more common Chapter 7 Bankruptcy (Liquidation). A Chapter 7
Bankruptcy is for consumers who are unable to pay the unsecured creditors,
and the purpose is to obtain an immediate "stay" (stopping) of collection
activities and, within a shorter period of time, obtain a "discharge" of
certain debts. Debtors can choose to voluntarily surrender secured collateral
such as motor vehicles, or can keep the collateral by "reaffirming" the
debt (become personally liable again). In a Chapter 7 Bankruptcy, the United
States Trustee is assigned to liquidate (take from you and sell) any property
that is not "exempt" (protected by law). In most cases there exists no
(or little) property to liquidate; but each case needs to be evaluated
by competent legal counsel to determine the exempt status of property.
